Duty holders, including SME's believe the Use of Work Equipment Regulations and the Lifting Operations and Lifting Equipment Regulations have led to safer equipment, improved working practices and a more competent workforce, concludes a HSE research report.
The same duty holders do not believe the costs of compliance have, on the whole, caused concern and the regulations are generally considered to be an improvement on the previous industry specific regulations.
However, more than one third of small businesses with equipment covered by the regulations had not heard of them and they have not yet generated detectable improvements in injury rates or apparent changes in defect rates or productivity.

SME's have never been so inundated by red tape and the accompanying forest of paperwork, as a result it's easy to understand how compliance with Health & Safety Legislation can be overlooked, or often ignored.
This however is extremely short sighted as this is one area apart from lack of sales that can have a devastating effect on a business.
Non compliance with Health & Safety Legislation carries the risk of being faced with a criminal prosecution that can result in the imposition of unlimited fines and two years imprisonment- per offence.
In addition, lives of employees, clients and their families are being put at risk.
Do not rely on your insurers picking up the bill for your failure as increasingly claims are being rejected if it can be shown that the loss was preventable, in addition compliance may be a pre-requisite of obtaining cover in the first place.
Farm Safety Appeal

 Farmers were today urged to make sure their machinery is in a safe condition following a farm vehicle safety initiative by Health and Safety Inspectors and the Police.
Peter Dodman, principal inspector responsible for agricultural activities in the North East said: "Transport- related accidents account for around 35% of all fatal accidents on farms.
We would advise farmers to make sure vehicles are properly maintained and arrange any necessary training, particularly for Fork Lift Truck drivers"
Simplifying Health & Safety in Care Homes

 The roles, functions and regulatory responsibilities of the three organizations involved in the control of Health & Safety in Britain's care homes and independent health care establishments are explained in a Memorandum of Understanding developed by the Health & Safety Executive, the Local Government Association and the National Care Standards Commission.

Motor Repairers Face Tougher Health And Safety Inspections
 The motor vehicle repairs industry is being warned to prepare for an
increase in Health and Safety Executive inspections following the
publication of HSE statistics that show it now stands alongside
traditionally unsafe agricultural activities in terms of accident frequency.
Even though this is largely due to improvements in the agriculture
figures, it shows the motor repairs industry has done little to improve
its safety record.
Motor repair workshops should expect an increase in the frequency of HSE
visits as more inspectors are being recruited and trained by HSE - 100
new recruits started in October - for the engineering sector.
Motor vehicle repair (MVR) counts as light engineering and provides a
useful training ground for HSE inspectors before they move into more
complex or heavier engineering activities.
Retail Motor Industry Federation (RMI) Environment, Health & Safety
Adviser, Peter Barlow, says: 'Inspectors dissatisfied with health and
safety arrangements will issue an improvement notice and deadline for
completion of the necessary actions, to which motor vehicle repair
businesses should react immediately. MVR businesses should seek advice
if they are unsure as to what is required.
